The Law of the Land – The Legalities of your Ownership
When “Kinyan Shmita” launched this unique venture at the top of the list of priorities, was forming the legal process of both civil and Jewish law to be incorporated in the legitimation and by laws of owning land in Israel prior to Shmita.
At the helm of the legal proceedings is Rabbi E. Landy, The Rav of Givat Ze’ev, who also heads the monetary Bais Din in Yerushalayim. His expertise is renowned in all areas of Halacha and is an established leading authority in Hilchos Shmita.
Working with Kinyan Shmita, Rabbi Landy, along with the top US and Israeli lawyers, drew up the infallible laws and rights of owning land in Israel for the purposes set by Kinyan Shmita. The legal documents meet international and Israeli law so that they would be universally law abiding.

This orchard became famous once again in the year of Shmita 2004. When a fire, vast and uncontrollable, broke out in Moshav Yashresh, tragedy struck, destroying every single orchard in the area. Except for one!

A Glimpse of Shmita
At the time of the Beis HaMikdash, observing Shmita was a Mitzvah from the Torah.
“For six years, you may plant your fields, prune your vineyards, and harvest your crops, but the seventh year is a Shabbos of Shabbosos for the land. This is Hashem’s Shabbos, during which you may not plant or prune your fields and vineyards. Do not harvest crops that grow on their own, and do not gather the grapes on your unpruned vines, since it is a year of rest for the land.” – Vayikra 25:3-4
Besides the four agricultural practices prohibited here, the Torah also forbids planting trees, whether or not fruit-bearing, and the plowing of all agricultural land.
Our Rabbis have also decreed that we may not do any agricultural and garden work during the Shmita year. We must leave land that is owned by Jews in Eretz Yisrael uncultivated.
Today, the commonly accepted view is that we consider all aspects of Shmita, Mitzvos from The Rabbis.
What is the true purpose of this Mitzvah?
The Sefer HaChinuch (Mitzvah 84) writes that the Mitzvah of Shmita serves as a reminder to the Jewish nation that Hashem is the Master of the world.
He commanded us not only to leave our land fallow but also to let go of the commodities, which, for this year, belong to everybody equally, instead of being the exclusive property of the owner.
This Mitzvah is to constantly instill within each one of us that the land produces fruit annually, not simply because it is its nature, but because that is the will of Hashem, the Master of the land and of the landowner. Therefore, in His awesomeness, Hashem can order us to leave our fields uncultivated and their produce unsold.
